Defense Litigation

Our attorneys are in court every day, in multiple venues and in multiple states. We represent professionals and businesses being sued in medical malpractice, employment law, premises liability and a variety of other tort and contract claims. Most representations utilize our expertise in medicine and healthcare.

In the provider-related area, we represent medical centers, ambulatory surgery centers, physician groups and surgeons in Fraud and Abuse, credentialing, disciplinary/peer review and professional liability defense. In medical liability defense, the firm has particular expertise in surgical specialties including neurosurgery, heart surgery, ophthalmology, otolaryngology, plastics, and head and neck surgery. In fact, head partner Neil H. Ekblom is a nationally known trial lawyer who lectures about risk management to professional groups in these specialties. Mr. Ekblom has over 50 jury defense verdicts in multiple states for surgeons in these areas.

In the premises liability area, we represent commercial landlords, large residential landlords, and sports facilities, including stadiums and ski resorts. The claims we handle frequently involve healthcare related issues including injuries requiring specialized evaluation. For example, we represent landlords in toxic tort cases and sports facilities sued over serious injuries.

Our Approach

Many clients who inquire about our services are interested not only in reducing the costs of litigation, but also in complete vindication at the trial level. This representation requires foresight and expertise through various stages of litigation to reach the ultimate goal of obtaining the best result possible, including a verdict. Continuity, oversight and communication all play an important role in bringing about the best result. We know that having the same attorney listening to the client is key, as is communication and review inside the firm among the partners. Conducting early investigations, choosing the right experts, and zealous advocacy all play important roles in obtaining optimum results.
